About the Position

We are looking for an experienced professional to join PayPal’s Legal team in the PRC. This position is based in Shanghai and will report to the China Legal Director based in Shanghai.

To succeed in this challenging role, candidates should be mature, self-motivated and independent, well-organized with excellent interpersonal, communication and problem solving skills. Being proficient in both Chinese and English (written and oral) is essential. This position also requires business acumen, strategic and creative thinking, strong project leadership, communication skills and multi-tasking capabilities.

Core Responsibilities

  • Providing advice on regulatory issues, relating to the Payment and Settlement law and regulations, Foreign Exchange Regulations, Data Privacy and Cyber Security Law etc
  • Working together with Government Affairs to establish and maintain good communication channels with relevant governmental authorities including the People’s Bank of China, provincial and municipal governments and other authorities
  • Drafting, reviewing and negotiating various commercial contracts including but not limited to those with clients, business partners and financial institutions e.g. banks, credit card companies, Foreign exchange licensed companies
  • Providing legal advices to Compliance and Risk Management department on AML/CTF or other compliance matters
  • Providing legal advice on business development cases, such as acquisitions and other important transactions in China
  • Advising on legal and regulatory risk issues relating to sales and marketing activities, communications, and product development
  • Monitoring ongoing legislation and regulatory changes, and advising the implementation of policies and procedures to address new regulatory requirements
  • Advising on employment and labor law issues
  • Providing legal advice to resolve commercial disputes, e.g. those incurred by customer complaints, including litigation, arbitration and administrative procedure
  • Working with the Asia Pacific legal team as a team member.

Requirements

  • Extensive expertise and experience in compliance, interpretation and enforcement of PRC law and regulations relating to online payment, clearing and settlement, foreign exchange, e-commerce, payments processing, data privacy, and cyber security
  • Broad background within the financial services industry, preferably within a bank or financial services organization, with minimum 3-year experience, including AML/CFT requirements
  • General legal background and experience with common issues related to internet payments, digital wallets, clearing and settlement, corporate, currency controls, foreign exchange, litigation and intellectual property.

Qualifications

  • Ability to work independently
  • An understanding of the financial legal and regulatory environment in the PRC. Specific knowledge of the laws and regulations relating to payments industry and/or electronic money would be preferred.
  • An understanding of and ability to develop and implement policies and monitoring programs
  • Excellent verbal and written communication skills in both Chinese and English
  • Ability to handle multiple tasks or projects simultaneously in a fast paced and dynamic financial services environment
  • Demonstrated ability to work with cross-functional teams as well as business unit leaders
  • Strong interpersonal skills with a focus on teamwork and ability to foster/manage relationships across multiple departments
  • Skill in focusing on desired results, clarifying next steps, and ability to prioritize effectively to meet deadlines, address risk and achieve desired results

Experience & Education

  • 3-5 years of experience working in a reputable company in the financial industry and/or practicing PRC law in the financial sector for a reputable law firm;
  • PRC bar qualification. Admission to major overseas jurisdictions is a plus.
  • Master degree major in law from a reputable university. Overseas legal education is a plus.
