As Product Counsel, you will be legal counsel for a fast-growing line of business within Capital One Auto Finance, the driving force behind Capital One’s position as the leading-edge U.S. financial institution auto loan originator. You will need to develop a deep understanding of our business and embrace the opportunity to grow from being an attorney for the business to becoming a valued strategic partner. You will skillfully identify and protect Capital One by navigating legal and reputational risks while working as part of a team developing and testing strategies that ultimately impact the bottom lines of both Capital One and our customers. You will work jointly with talented professionals to develop innovative digital products and services that provide consumers with a transparent, user-friendly experience designed to help them save money on their auto loans.

You will need to bring the following to Capital One for this role:

Strong communication skills are required, coupled with influencing abilities that can drive consensus among multiple stakeholder groups through intellect, negotiation and interpersonal skills. Intellectual curiosity and learning agility is essential in order to understand complex ideas and break them down into granular concepts that drive business initiatives. A successful track record of enjoying and thriving in a fast paced, entrepreneurial environment is also strongly preferred.

Your primary job responsibilities will include:

Translating: Understanding the law (e.g., privacy, IP, Reg Z, Reg B/ECOA, FCRA, UDAAP), applying your legal knowledge to business initiatives, and articulating your advice in clear, relatable and easily-digestible terms to your business colleagues. You’ll translate among business intent, regulatory requirements, legal guardrails, customer-focused initiatives, and enterprise best practices. You won’t need to know everything about everything, but you’ll continue to learn more than you expect and will need to know at least a little about a lot.

Navigating: Understanding the auto originations business, the competition and technological innovation in our space, fostering innovation through an understanding of the applicable laws, and charting a course for testing and rolling out initiatives. You’ll drill down into how we do what we do, and why we do what we do, so you can be an important part of teams that want to do it in a better way. As you assist the business in its focus on “customer experiences,” you will also help the company navigate complex regulations. You will also serve as the headlight for the business as they continue to venture onto new roads, giving strategic and directional guidance that helps the business move forward.

Developing: Recognizing our marketing intent and strategy; working with the business on marketing creatives; and then reviewing them with an eye toward identifying and explaining risks. You get to help the business figure out what they’re trying to say and how they can say it better. You will actively apply your knowledge of applicable statutes and regulations to the development of marketing materials.

Partnering: Collaborating closely with colleagues across the Legal Department to fully vet and scale risk. You’ll work to push responsible innovation in challenging gray areas. We place a high value on intellectual curiosity, particularly when combined with a “let’s get things done the right way” attitude.

Embracing: Working hand-in-hand with the business to solve problems in flight – and embracing the role. You’ll need the desire to be an integral part of the business team in all facets, while maintaining the right mindset on mitigating legal risk. And you should have willingness to learn technology (APIs, AI, machine learning), especially how it is being actively developed and used by our company, your business partners and the Legal Department.

Basic Qualifications

  • JD and member in good standing of at least one state bar.

  • At least 4 years of experience as an attorney in a law firm or as in-house counsel, working on regulatory, advisory or litigation matters.

Preferred Qualifications

  • Over 5 years of experience as an attorney in a law firm or as in-house counsel, working on regulatory, advisory or litigation matters.

  • At least 1 year of experience in advising financial services or emerging technology companies on consumer lending regulatory matters.
